Terms of Service

By downloading or using Fytix, you agree to these Terms of Service. If you do not agree, do not use the app.

1. Eligibility

You must be at least 4+ years old to use Fytix. By using the app you confirm that you meet this requirement.

Fytix is not a medical service. Always consult a qualified healthcare professional before starting a new fitness or nutrition program.

2. The Service

  • Fytix provides AI-assisted workout planning, exercise logging, nutrition tracking, health data integration, and progress monitoring.
  • We do not provide medical advice, diagnosis, or treatment. Content in the app is for informational and motivational purposes only.
  • Features may change, be updated, or be removed at any time.

3. License to Use the App

a. Grant of License

Subject to your compliance with these Terms, Fytix grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Fytix app on a device you own or control.
  • Access and use the app solely for your personal, non-commercial fitness purposes.

b. License Restrictions

You may NOT:

  • Copy, modify, or create derivative works of the app.
  • Distribute, transfer, sublicense, lease, lend, or rent the app to any third party.
  • Reverse engineer, decompile, or disassemble the app, except as permitted by applicable law.
  • Use the app for any commercial purpose without written consent from Fytix.
  • Remove, alter, or obscure any proprietary notices on the app.

c. Updates and Modifications

  • We may update the app to add features, fix bugs, or improve performance.
  • You may need to install updates to continue using all features.
  • We reserve the right to modify or discontinue the app at any time without notice.

d. Ownership

The app and all rights, title, and interest in and to the app (excluding your personal data) are and will remain the exclusive property of Fytix / Globax Apps.

4. User Content

a. Your Responsibilities

You confirm that:

  • You own or have rights to any content you upload (e.g. progress photos, custom workouts).
  • Your content does not violate any laws or third-party rights.
  • You do not upload illegal, harmful, or abusive content.

b. License to Your Content

You grant Fytix a limited, non-exclusive license to store and process your content solely to provide the service (e.g. displaying your progress photos to you, syncing your workout history).

5. Health & Fitness Disclaimer

Exercise involves inherent risk. Fytix is not a substitute for professional medical advice. Consult your doctor before starting any new training or nutrition program.

  • Workout recommendations and nutrition targets are general guidelines based on the data you provide. They are not personalised medical advice.
  • Fytix is not liable for any injury, illness, or adverse outcome resulting from following content in the app.
  • If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention.
  • Health data read from Apple HealthKit (steps, heart rate, sleep) is used only to display insights to you — not for medical diagnosis.

6. Subscriptions & Purchases

a. Subscription Plans

  • Fytix offers subscription plans that unlock premium features such as advanced training plans, AI coaching, and detailed analytics.
  • A Fytix subscription is sold to an individual user and may not be shared.
  • Current pricing and plan details are displayed in the app at the time of purchase.

b. Free Trials and Promotional Pricing

  • We may offer free trial periods for new subscribers.
  • Trial terms are clearly disclosed when you select a subscription plan.
  • After your trial ends, your payment method will be automatically charged at the regular subscription price unless you cancel before the trial expires.

c. Auto-Renewal and Billing

  • Subscriptions auto-renew at the end of each period unless you cancel beforehand.
  • All payments are processed by Apple App Store or Google Play Store.
  • We reserve the right to change pricing with advance notice.

d. Cancellation

You may cancel your subscription at any time through your device settings:

  • iOS: Settings → [Your Name] → Subscriptions → Fytix → Cancel Subscription
  • Android: Google Play Store → Menu → Subscriptions → Fytix → Cancel Subscription

Upon cancellation, you retain access to premium features until the end of your current billing period. No partial refunds are issued for unused time.

7. Prohibited Uses

You agree not to:

  • Use the app to upload or share illegal, abusive, or inappropriate content.
  • Attempt to reverse-engineer, hack, or interfere with the app or its servers.
  • Use automated tools, bots, or scrapers on the service.
  • Impersonate another person or misrepresent your affiliation with any entity.
  • Share or sell your account credentials or subscription access.
  • Violate our Community Guidelines.

Violation may result in suspension or termination of your account.

8. Account Termination

We may suspend or terminate your access if:

  • You violate these Terms or our Community Guidelines.
  • You misuse the service or engage in fraudulent activity.
  • Required by applicable law.

You may delete your account at any time via Profile → Privacy & Security → Delete Account, or by emailing support@fytix.app.

9. Intellectual Property

a. Our Property

  • All app content, branding, workout plans, exercise databases, and technology belong to Fytix / Globax Apps.
  • You may not copy, modify, or redistribute our content without permission.

b. Your Data

  • Your personal fitness data (workouts, weight logs, nutrition logs, progress photos) remains yours.
  • We do not sell your personal data to third parties.

10. Refund Policy

  • All purchases and subscriptions are processed through Apple App Store or Google Play Store.
  • Refunds are subject to the refund policies of Apple and Google, not Fytix.
  • Subscriptions are generally non-refundable for the current billing period.
  • To request a refund for an App Store purchase, contact Apple Support directly.
  • Refunds may be granted at our discretion in cases of technical failure or service unavailability.

11. Disclaimer of Warranties

The app is provided "as is" and "as available." We make no warranties regarding uptime, fitness results, or accuracy of health insights.

  • We do not guarantee that the app will meet your specific fitness goals.
  • We do not warrant uninterrupted or error-free service.
  • We are not responsible for loss of data or content.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Fytix is not liable for indirect, incidental, or consequential damages.
  • We are not liable for loss of profits, data, or fitness outcomes.
  • Total liability is limited to the amount paid by you in the last 12 months.

13. Indemnification

You agree to indemnify and hold Fytix harmless from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or violation of any third-party rights.

14. Changes to These Terms

  • We may update these Terms at any time.
  • Significant changes will be communicated via in-app notification or email.
  • Continued use after changes constitutes acceptance.
  • If you don't agree to updated Terms, you must stop using the service.

15. Apple App Store Terms

a. Acknowledgment

  • These Terms are between you and Fytix only, not with Apple Inc.
  • Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.

b. Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

16. Governing Law

These Terms are governed by the laws of the jurisdiction in which Globax Apps operates, without regard to conflict of law principles.
